The new rules aim to prevent the sale and free distribution of nitrous oxide to minors within city limits. Besides establishing legal groundwork and an action plan for enforcement, an awareness campaign about the hazards of nitrous oxide consumption will be launched. Moreover, the city council will scrutinize whether the consumption of nitrous oxide can be prohibited in public playgrounds, near schools, and kindergartens.
Nitrous oxide, often known as a 'Partydrogue', has been gaining popularity amongst the younger crowd for several years. The sweet-smelling gas, when inhaled, produces a fleeting high. However, the Federal Center for Health Education warns that the gas, unclassified as a narcotic under German law, is freely available for purchase. Consumption, however, can lead to unconsciousness, heart and circulatory failure, shortness of breath, and neurological damage.
Hanau was the first city in Hessen to introduce such a restriction on the party drug in March. It also prohibits consumption near playgrounds and schools. Frankfurt followed suit in early May, with a ban that includes distribution, like in balloons. Similar restrictions on nitrous oxide are in place in cities like Osnabrück, Hamburg, and Dortmund.
Hessen's health minister, Diana Stolz, welcomed the growing number of cities imposing such bans. "Nitrous oxide is not a harmless pastime, but a danger to children and young people whom we must warn and protect against consumption," she stated. Stolz supports a nationwide ban on the party drug and is hopeful about the new Federal Health Minister taking action to stop or regulate sales, even at machines and through mail order.
In a bold move, Stolz had already raised this topic for discussion at the next health ministers' conference in Weimar. The new Federal Health Minister, Nina Warken (CDU), had previously announced that banning nitrous oxide as a party drug would be one of her top priorities.
