Mogilev Resident Wins Court Battle against Developer for Stress over Unfinished Apartment

The Mogilev Regional Court has ruled in favor of a local resident after a dispute with a developer over an apartment with various defects upon handover.

According to the court press service, the resident received an apartment with supposedly finished repairs. However, an inspection found numerous issues such as uneven walls, damaged doors and skirting boards, and poorly pasted wallpaper.

Despite some corrections by the developer, certain problems remained unresolved prompting the owner to file a lawsuit. In court, the resident argued that the unfinished work left him unable to move in with his family despite ongoing utility and credit payments.

He claimed compensation for emotional distress as well as reimbursement of legal costs. The court, referring to Article 18 of the Belarusian Law "On the Protection of Consumer Rights", found grounds to grant the claims. However, the compensation amount was reduced to Br1000.

In many similar cases, consumer laws often grant compensation for both financial and emotional harm caused by incomplete work. Such laws typically have specific procedures for filing claims, burden of proof, and criteria for determining the amount of compensation.

Without further details on the specific provisions of Belarusian law regarding compensation for moral damages, it is advised to consult local legal resources or a legal professional for more precise information.

The unfinished apartment repairs caused significant stress to the Mogilev resident, impacting not only his physical health-and-wellness but also his mental-health. He successfully argued for compensation for emotional distress in his court case, demonstrating the importance of addressing mental-health issues stemming from incomplete work, a matter often covered under health-and-wellness regulations in consumer laws.
